Dear New Hampshire Citizen:

1. The Joker (Batman) is after me; but I am now after him

It has been a month since I wrote you a special letter from the First Congressional District campaign, and what a month it has been. The Joker (Wayne McDonald) keeps following orders to sabotage the Republican Party and destroy my campaign. All McDonald has accomplished is to destroy the Republican Party and make it into a laughingstock.

I’m not going anywhere. My family has been in New Hampshire for 102 years. But McDonald, The Joker, is on his way to the wastebasket, or worse, maybe even the hoosegow.

How is it that the Democrats manage to handle eleven (11) congressional candidates but The Joker pretends there are only two (2), not including me, running in the First District? That’s why Democrats win and Republicans lose. They bring people in; The Joker tries to keep people out.

2. The dumbest political contributor, Alicia Preston

But that’s not the best piece of news. I have a nominee for dumbest political contributor in New Hampshire to date (this is a fluid category and other dopes-in-waiting may be out there, in fact they almost certainly are, are you reading this Paul Steinhauser?).

Alicia Preston, whom some of you may know, has published the dumbest and most incompetent piece of commentary I have seen recently. Please see link [1] below. Maybe Preston is dumb because The Joker’s antics have deprived her of election information; that, after all is the self-destructive manual McDonald is using to defeat me. (“What if they gave an election and pretended one of the candidates didn’t exist?).

Preston says there are only “two” candidates. Well, there are more than two, at least three including me, who are campaigning fiercely.

Preston was completely ignorant of the fact that my Right to Know (RTK) negotiations with the Attorney General have devastated both the Sanborn and Edwards campaigns. My campaign, not the local fake news media in Manchester, opened a veritable Pandora’s Box into embarrassing factual information involving my two opponents. Not only has my RTK work effectively ended the Sanborn campaign, Preston was blathering in her column without even seeing the latest reporting on Saturday (she has been added to my email list, but she doesn’t appear to check the fake news media either.)

I have to work overtime, without pay, to get my news out quickly because John DiStaso of WMUR steals all of my work and pretends it is his own. I negotiated the “Sanborn papers” release with the AG, but DiStaso continues to lie to his viewers and readers and claim the disclosures coming out are a result of his work. Liar, liar TV station on fire.

Preston is so stupid she wrote a piece for Seacoastonline.com (a future nominee for most fake news media operation in New Hampshire when we sue them) suggesting Sanborn had only made one bad remark. She didn’t even know that there were years of bad conduct by Sanborn. We need a separate file box to catalog all the bad things he did to women (his assistant” was taken away because he sexually harassed her constantly, and so on..[see below])

So, I nominate Alicia Preston for dumbest political writer. Do you have a better suggestion?

3. Now for the good stuff – I suspect it’s gonna get nasty

Several weeks ago I attended an event. A member of the media came up to me with a pretty wild story. The media guy said Andy Sanborn’s bar (The Draft in Concord) had a lower level with rooms where bad things could happen. There were even rumors about Sanborn taping people, in what sounded like his own version of the “Boom Boom Room.” (Please see link [2] below.)

Both my campaign manager and I are seasoned analysts and investigators. My biography (www.AndyMartin.com) lists some of the places I have been. Just because we hear something that sounds crazy, we do not necessarily erase the claim from our memory.

After the event where Sanborn’s “room” was disclosed my manager and I talked about Sanborn’s possible “Boom Boom Room” and the possible existence of tapes Sanborn has made secretly, possibly for blackmail purposes. But we had nothing more to go on, so Sanborn’s Boom Boom Room issue went into the “Work In Progress” file on the computer. No action.

Until Friday, August 18th.

Late Friday, at almost 6:00 P.M., pursuant to our Right to Know agreement, the Attorney General released heavily redacted transcripts from interviews conducted with people involved in the Sanborn Scandal. We don’t know what the AG is covering up but we plan a lawsuit (John DiStaso won’t be able to steal that material because we will ask the court to keep in under wraps except for me.)

So what set off the bells ringing at my campaign War Room?

The transcripts revealed that the intern who was/is at the center of the Sanborn Scandal was invited by Sanborn to go to a “room” in the basement of The Draft, where Sanborn made “uncomfortable” leading remarks. (Yes, this is all there, under oath, in the RTK documents.)

It looks as though Sanborn did have/does have a Boom Boom Room.

The Sanborn Scandal is exploding like a political supernova. And, under my agreement with the AG, there are more documents to come. New Hampshire has seldom seen anything this lurid, and it is all brought to you courtesy of my campaign and campaign staff. We beat the pants off the local fake news media.

4. The bottom line

I was featured on the CBS TV network 25 years ago. A decade ago I was at the center of the presidential race, with one of the most controversial interviews of the entire election on Fox News. Please see link [3] below. The New York Times put me on page one as one of the nation’s most dangerous conservative political operatives (wouldn’t you love to have me in Washington?).

I have debated on ABC television in Chicago, but a small town station such as WMUR says I’m not good enough for Manchester. When The Joker and WMUR try to prevent me from appearing in debates, they are showing how low class they are. They are engaging in a conspiracy to rig an election.

So, guess what. I am slow to anger and slow to take action. But I have had enough of New Hampshire’s media losers and crooked politicians starting with The Joker treating me with disrespect. No more Mr. Nice Guy. If WMUR wants to play dirty, I will hit them where it hurts, in their pocketbook. If the Joker wants to harass me, he will pay a greater political price than his demented mind can imagine. The gloves are off.

Republicans nationally have been called “the stupid party.” In New Hampshire, The Joker and his Concord cronies are proving, one more election cycle all over again, they are “the Losers’ Party.” What the Joker is doing to me is backfiring across the entire team of GOP candidates. McDonald may defeat the entire Republican ticket in November, all in an insane plot to destroy my candidacy.

A famous Navy man (no, not Eddie Edwards) once said “I have not yet begin to fight.” Well, in New Hampshire in the First District, the fight is on.

(Manchester, NH)(August 19, 2018) — Republican congressional candidate Andy Martin was invited to join the New Hampshire Farm Bureau Federation and he accepted. Martin becomes the first congressional candidate in either party to be committed to New Hampshire’s farmers.

“The Farm Bureau had an event for candidates a few days ago,” Martin says. “And I was invited to join. I joined.

“I grew up down the street from a neighborhood dairy. Summers always involved hanging around the bottling plant for fresh strawberry milk. “My uncle Lucian Marcoux owed a home which backed up to the pasture. One lot over from my home there were horses.

“But even then farmers were struggling financially.

“Later, I spent time in the Midwest and became acquainted with mass production agriculture. I have been exposed to farming from the neighborhood family farm to the 640-acre mega-farm (today farms are much larger).

“New Hampshire agriculture is important to our state’s quality of life. But farmers are threatened. Dairy farmers are caught up in the politics of tariffs between Canada and the U.S., as well as facing relentless cost pressures and significant regulation. Local governments are always seeking to extend their control over agricultural land. And on and on. Federal bureaucrats have an insatiable appetite for extending their demands down into every barn and pond.

“I am proud to say I will be New Hampshire’s voice on agriculture in Washington. Farmers will have a friend. Farmers will be able to pick up the phone, like everyone else in my district, and speak to me directly. No aides, no intermediaries, no levels of congressional office bureaucracy. Time will be set aside for direct contact.

“We’ll use technology to enhance access for everyone, not just lobbyists and special interests. Today congressmen are too far removed from their constituents. The former representative who said recently you had to ‘pay to play’ disgusted me.

“In the midst of all of the ‘national’ issues and our foreign challenges and conflicts we confront during a campaign, it is also important to stay grounded here at home in the Granite State. The Farm Bureau will help me do that.

“I am very proud of my new affiliation and I will do my best to see New Hampshire’s farmers get fair treatment in Washington and here at home,” Martin concluded.

Sex dossier exists, whereabouts unknown, in Sanborn investigation

Andy Martin challenges Eddie Edwards to debate, says Sanborn is through as a serious candidate

(Manchester, NH)(August 18, 2018) — Republican congressional candidate Andy Martin will hold a news conference, by appointment only, Saturday to discuss the latest “bombshell” disclosures in the case of the New Hampshire Attorney General’s investigation into State Senator Andy Sanborn.

“At 4:45 P.M. on Friday we got a document dump from the New Hampshire Attorney General (“AG”),” Martin says. “Then we got a call from the AG that they had released raw files by mistake, with a request we delete the raw files. We agreed and we got a second ‘redacted’ document dump about an hour later.

“I suppose that by now most people thought there were no more surprises in the Andy Sanborn sexual harassment case. They were wrong.

“The latest transcripts from witness interviews indicate that the victim of one of the senator’s abuses kept what I call a ‘sex dossier’ of all of Sanborn’s inappropriate remarks for approximately two (2) years. The current location of the sex dossier is unknown. Sanborn’s misbehavior was not a single incident. He was crass and inappropriate throughout his entire senate career. There is apparently a video of a tearful intern, again a new development. Sanborn is a man voters want to send to Washington? No one is that crazy, even in New Hampshire.

“Thursday New Hampshire Republicans held a bogus ‘debate’ from which I was excluded. Wayne McDonald and the people behind him are trying to discredit me to protect Sanborn. This is crooked politics of the worst order, and may involve a new and independent crime. In other words, the latest cover-up by Wayne McDonald and his coconspirators to destroy my campaign may be criminal activity under federal and state law. The cover-up may become worse than the original ‘crime.’

“I asked Sanborn to step down on June 16th. I negotiated a deal with the AG in late June. Both the AG and I have kept our sides of the bargain. We continue to work together pursuant to the state’s Right to Know (“RTK”) law.

“In addition, while I have not seen the missing portions of the witness transcripts that were redacted, I have seen the redactions themselves (whited out areas) and my quick guess is that in one deposition alone ten (10) pages of testimony were removed from public view.

“Because it’s August and because we’re very busy on Saturday, we have scheduled a ‘by appointment only’ news conference. If we are called and told someone wants to do an interview, we will be at City Hall at noon, sort of a ‘flagged down’ train stop. If we do not get a call, we will not stop there.

“Crooked politicians in the Republican Party are trying to silence and discredit me and promote and protect Andy Sanborn.

“While Eddie Edwards and I arrive the same conclusion by different approaches, we both agree Sanborn is both unelectable and that no responsible and respectable party would nominate Sanborn for anything. Ironically, Edwards himself is mentioned in one of the AG interviews, concerning a Derry appearance by both men.

“When I said yesterday that the congressional race was now a two-man contest between myself and Edwards, some may have thought I was delusional or engaging in hyperbole. The latest Right to Know evidence confirms I have been right about Sanborn since June. Only the ‘omerta’ of corrupt Republican Party leaders has kept Sanborn in the race.

“When Edwards feels confident enough of himself, I am anxious to debate him so we can determine who the best man is to represent the First District. Rather than excluding me from debates, it is now time to exclude Sanborn.

“Eddie are you ready?

The latest disclosures abut the Sanborn investigation will shock even the most jaded observers of America’s Peyton Place of politics, crooked New Hampshire.

“I am fighting to represent the voters and good citizens, and to clean up the corruption so Granite Staters can once again have a government they can be proud of. Sanborn must go.

“People are under the mistaken impression that Sanborn’s misbehavior was a one-and-done ‘mistake.’ The witness transcripts reflect years of misconduct and suspicious activity by Sanborn.

“Later this month I hope to have the resources to post the actual transcripts of the Sanborn investigation online, so every Republican primary voter can see what I have seen and decide if I am the best man to speak for them in congress. Unlike most political blather, we have sworn transcripts to accompany our accusations.

“I have national, major market experience in media and investigations. It took someone who had lived ‘outside’ New Hampshire to come home and clean up the ‘inside’ of insider politics that has contaminated Concord. I am very proud of the influence I have had cleaning up politics in this state; in the words of that great Navy man, ‘I’ve just begun to fight.’

“As Joe Louis once said, my opponents ‘can run, but they can’t hide.’ They can conduct fake debates but the fake news media can no longer protect them from investigation and exposure.”

(Manchester, NH)(August 14, 2018) — Republican congressional candidate Andy Martin received the news late Wednesday night after a long day of campaign appearances: Eddie Edwards was refusing to endorse Andy Sanborn after the September 11 primary. Please see note [1] below.

“In my opinion, we are now down to a two-man race, me and Eddie Edwards,” Martin announced. “Last June 16th I promised – Babe Ruth-style – that I would take down Sanborn. Now that Edie Edwards refuses to support Sanborn if Sanborn wins the primary, Sanborn is effectively out of the race. He is toxic. No one can take him seriously as a credible candidate in November.

“How did all this unfold? On TV they say, ‘Let’s go to the tape.’ In courts, we say ‘Let’s look at the record.”

“When the Attorney General announced in early June, 2018 he would not prosecute Sanborn the story died. The media went on to reporting other nonsense. Only my campaign unit, which we humorously call our ‘Bureau of Investigation,’ pursued release of the secret Sanborn files. Then I asked Sanborn to step down.

Dear Andy:

This is a difficult letter to write. But in the interest of New Hampshire Republicans I am compelled to ask you to withdraw as a candidate for congress in 2018. I believe the basis for your withdrawal is compelling. I further believe that if you do not withdraw, your potential presence on the November ballot could endanger Republican candidates in both state and federal races.

1. You have accused your “political enemies,” i. e. “liberal Democrats, of conspiring to defame you (Union Leader 12/9/17). But both of the investigations involving your admitted misconduct were directed by Republican senate presidents, Peter Bragdon and Charles Morse. So the claim that Democrats have been out to get you is so hollow it borders on a lie.

2. You admitted to the Union Leader (12/9/17) that you used “crass language,” apparently directed at a state employee. You then tried to minimize your misconduct, by seeking to trivialize your self-admitted crass conduct, saying “it is disgusting that anyone is trying to equate a crass joke to all the real challenges women are facing…” (Union Leader 12/9/17)

By your own admission you are unaware that the use of “crass language” is one of the most serious forms of sexual misconduct. How stupid is that? What do you think Ray Buckley’s smear machine will make of your own admissions? Your own words! Maura Sullivan will rip you to shreds.

3. Senate President Peter Bragdon opened an investigation in 2013. Thousands of dollars were paid to an out-of-state law firm to investigate. A cash envelope was handed to a state employee, the purpose, amounts and connection to you remain opaque, even after five years and two investigations. Bragdon is a Republican. Morse is a Republican. They acted because of the undeniable appearance of impropriety.

Last year Senate Chares Morse asked for a new investigation, the second one. Eighteen (18!) tapes exist. The Attorney General presented the matter to a grand jury. Vital facts are still in dispute and unresolved.

You have denied you committed a crime.

4. While I am seeking full disclosure of all evidence under New Hampshire’s Right-to-Know law and I will be moving expeditiously to ensure that release, I agree that you probably did not commit a crime. I am reserving final judgment until the tapes and evidence are released to the public. But that misses the point.

Most boorish behavior and sexual harassment is not criminal, it is a civil offense and an affront to civilized of professional behavior. The quotations attributed to you in the Union Leader show you have no idea that your behavior was despicable and unlawful as a civil matter.

5. Your misconduct cost taxpayers tens of thousands, perhaps hundreds of thousands of dollars in both outside legal fees and insider state employee time to investigate your incident twice. Assistant Attorneys General were paid, investigators had to assemble the evidence. That activity cost taxpayers a small fortune. You claim the investigations were all about nothing. Then why did the matter end up in front of a grand jury? Are you suggesting the Attorney General presents frivolous matters to a grand jury for review? The answer is obvious.

6. Nevertheless, the finding that no crime was committed is irrelevant. Your conduct does not have to be criminal to render you unfit to serve in congress. So the “I am not a criminal” defense is unavailing.

You yourself have admitted to unlawful behavior that would get you fired in the private sector. Are the New Hampshire state legislature’s morals any less exacting? They literally had to “change the rules” after your misconduct. In the law of evidence, subsequent remedial conduct (by the state senate) is evidence of prior unlawful behavior.

7. I hope you will heed my experienced analysis and withdraw or not file by the close of the filing period on June 15th. Your withdrawal, however, will not stop my Right-to-Know demands to the Senate President, the Attorney General and the Grand Jury (the grand jury’s secrecy can be overridden in a public matter such as yours). There will be no cover-up. Too many questions still remain.

8. You could also undermine your wife’s candidacy for state house speaker. That would be unfortunate. She was present and witnessed your self-admitted crass behavior. The best approach? Withdraw by tomorrow, and consider a run in 2 years when matters will have quieted down.

9. And don’t think the liberal media, the Union Leader and WMUR, will save you. Two years ago I exposed that Jim Lawrence, who claimed to be a “small businessman” had “no business” at all, because his business had been dissolved by the state. The federal government had barred him from bidding on most federal contracts, while Lawrence continued to masquerade as a government contractor. Lawrence had unpaid taxes. All of this information was basic public information and should have been presented to Republican primary voters by honest media.

But New Hampshire’s fake news media concealed the truth from voters.

The Union Leader and WMUR censored my campaign to cover up Lawrence’s misconduct. They treated a “fake candidate,” Lawrence, as though he was a serious candidate despite all of the evidence to the contrary, and they held back the evidence until it was too late for Republicans to vote against Lawrence in the primary. Then they smeared Lawrence just in time to reelect one of the wildest liberals in congress, Annie Kuster.

The same fate lies store for you. The liberal media will play possum until after the primary and then “discover” the evidence in time to elect Maura Sullivan.

Pull out, lie low and wait to see what materializes in 2020. That is your best course, really your only course, whether you want to admit it or not.

We compromised on a staged release of Sanborn materials, and it was through my agreement with the AG that we learned of the ‘second’ victim of Sanborn’s crass behavior. The fact that his assistant had been removed by other senators shocked the GOP. The final batch of Sanborn documents is due this week. I never had to file a lawsuit to get them.

(Manchester, NH)(August 16, 20128) Andy Martin’s lawsuit against The University of New Hampshire Survey Center, St. Anselm College, WMUR, the Union Leader, CRES and other defendants has been filed with the Clerk of the Superior Court.

“I believe elections should be settled on Election Day,” Martin says. “But when powerful interests engage in blatant fraud and corrupt the electoral process, conducting fake ‘debates’ and using fake candidates to undermine my campaign, going to court is a last resort, not a first one.

“Just look at how the Democrats have treated their eleven (11) candidates. With fairness and grace. Slimy Republican leaders are trying to rig our primary to favor two (2) candidates. Whatever happened to democracy? The Democrats win elections because they treat primary candidates with respect, and unify after the primary. Republicans try to fix primaries, and falsely believe the fake news media are their allies. But all of this GOP dirtiness boomerangs and defeats Republicans in November. Wait and see.

“The long-term effects of the defendant’s corruption of New Hampshire’s political process will be substantial. The complaint has been posted on the Internet, as a first step towards warning the public and the American people. We want to alert individuals who might come to New Hampshire to study or participate in our FITN primary.

“The irony is that my opponents and I get along pretty well on the campaign trail. We crack jokes about each other at joint appearances. It is the self-styled GOP leaders and local media that are corrupting the process. Of course all of this unnecessary turmoil ultimately hurts Republican candidates. I wonder if there is a pro Democrat, ‘Manchurian Candidate’ ‘leader’ in the state GOP who is undermining the primary election process.

“We intend to terminate the calamity of corruption that has been inflicted on the good citizens of New Hampshire’s campaigns and elections. Before we are over the defendants will pay a heavy price indeed, both in court and out of court. President Trump and I are both fighters. COMPLAINT FOR DECLARATORY JUDGMENT,
MONEY DAMAGES AND OTHER INJUNCTIVE RELIEF

Introduction

1. Over sixty years ago the novel “Peyton Place” scandalized New Hampshire as a state driven by bigotry, ignorance, pettiness, corruption and backstabbing. Granite State residents were scandalized, embarrassed and took a dislike to having the truth of their squalid social behavior shoved in their faces.
2. This lawsuit explains why New Hampshire has become the Peyton Place of American politics, and how the arrogance, corruption, bigotry, ignorance, bias and malignancy of the media establishment rotten leadership in the Republican party have essentially enslaved Republican voters and made them into permanent losers. The lawsuit is documented with their public statements and prior history of the defendants themselves; they cannot escape judgment by expressing surprise or outage at the plaintiff’s disclosures for all of them are factually based.

COUNT ONE

[Polling fraud – New Hampshire Common law claims –
declaratory judgment and common law fraud]

I.
Limitations

Although the factual allegations against all defendants are presented in this Count, the substantive legal accusations are limited primarily to defendants University of New Hampshire and St. Anselm College. Many of the other defendants, however, have exploited the fraudulent polling activity of UNH and STA, particularly the Union Leader and WMUR.

II.

Jurisdiction and venue

1. The Court has general common law jurisdiction to hear all of the claims presented in this civil action under the New Hampshire Constitution and Statutes. New Hampshire political parties are subject to extensive supervision and regulation by the state, see e.g. Title 63 NH Stat., Sumner v. NHSOS, 136 A.3d 101, 104 (N.H. 2016).
2. Venue is proper in Merrimack County due to the presence of a defendant which is headquartered in Merrimack County.
3. Plaintiff demands a jury trial.

II.

Factual allegations

Note: Although New Hampshire is a “notice pleading jurisdiction,” Porter v. Manchester, 151 N.H. 30, 43, 849 A.2d 103 (N.H. 2004), Plaintiff provides considerable factual detail because he is seeking emergency injunctive relief.

1. The Plaintiff
A. Plaintiff is a legally qualified candidate for U.S. Representative from New Hampshire, District 1. Plaintiff has decades of extensive public and political experience (www.AndyMartin.com, http://www.AndyMartin2018.com). As required by federal law, Plaintiff has registered with the Federal Election Commission and filed with the New Hampshire Secretary of State for the September, 2018 primary election.
B. Plaintiff has been featured on a segment on the CBS Television Network. He appeared in what many political observers considered the most controversial cable TV program of the 2008 presidential election, see: http://www.youtube.com/watch?v=RgjQhnDEGSk.
He has repeatedly “debated” in the nation’s third largest television market on the ABC affiliate, WLS-TV.

C. Plaintiff’s seriousness as a political actor and his national experience and presence cannot seriously be questioned. The defendants’ relentless efforts to denigrate and literally erase Plaintiff’s political status are an embarrassment to the citizens of New Hampshire, who are stuck squarely within the parameters of being manipulated and controlled by what President Trump calls “fake news” media.
D. Plaintiff learned of a “debate” being conducted by the Republican State Committee defendants on or about August 6. Plaintiff has not been invited to participate, see Group Exhibit A. In an email to Plaintiff, Exhibit A, defendant Wayne McDonald claims the debate is directed at the “good people of New Hampshire,” so there is no denying a general public event is being orchestrated using the assets and resources of the Republican State Committee and its “partners” in fraud to deceive the New Hampshire public.
E. Plaintiff contacted Wayne McDonald, Exhibit B, who as of the early afternoon of August 10 has refused to reply. McDonald, Exhibit A, promised “qualifications” by August 8th but as of the early afternoon of August 10 when this Complaint was prepared none have appeared.

2. The defendants

A. Polling fraud
a. Plaintiff has been active in Republican politics for almost a decade. In 2016, the UNH “Granite State Poll,” which on information and belief is partially funded by media, published ambiguous reports on Plaintiff’s polling status in a congressional primary. The Survey Center’s 2018 results, however have no such opacity.
b. Exhibit C is clear that while UNH polled on nine (9) Democratic candidates, they polled on only two (2) Republican candidates and eliminated Plaintiff’s name entirely.
c. It would be impossible to claim that all of the nine Democrats were more serious or substantial candidates than Plaintiff but, Soviet-era style, Plaintiff was simply “erased” and rendered nonexistent in the Republican candidate polling.
d. The gross imbalance between Democrats polled, and the Republicans, shows that UNH was clearly interested in promoting the Democratic Party, not achieving balance in a state that is almost evenly divided between Republicans and Democrats. UNH is a public, taxpayer-supported institution but it has become known and despised as a fulcrum of extreme left-wing activity; the latest biased polling activity confirms doubts about the academic ingenuity of UNH.
e. St. Anselm’s, which claims to operate an “Institute of Politics,” may be motivated more by Chicago values of corruption and fraud, than New Hampshire values of public integrity and fairness. STA polled on eight (8) Democrats and two (2) Republicans, also erasing Plaintiff’s candidacy.
f. STA is not taxpayer supported, but it is a tax-exempt, taxpayer encouraged institution and it rapidly catching up to UNH in arrogance and corruption with its own biased polling methodology.

B. Debate fraud by iHeart Media, WMUR and Union Leader
a. iHeart Media, Jack Heath and New England College have a long history of debate fraud, bogus “qualifications” exclusions and other fraudulent devices intended to defraud both the New Hampshire listening public and the Federal Communications Commission.
b. In 2016, WMUR and the Union leader engaged in blatant debate fraud. To defeat Plaintiff by erasing his candidacy, WMUR/UL promoted a “fake candidate,” Jim Lawrence.
c. Lawrence claimed to be a “small businessman,” but his business had been dissolved by the State of New Hampshire. Lawrence claimed to be a “government contractor,” but a published opinion had barred him from competing for most government contracts. Lawrence was too inconvenienced to pay his real estate taxes, while chanting a political mantra from the 1970’s. Plaintiff distributed in June, 2016 damaging facts about Lawrence but WMUR/UL continued to use Lawrence as a decoy in dummy debates.
d. After Lawrence was successfully used to rig the 2016 primary, WMUR and the Union Leader disclosed that Lawrence was a fraud and defeated him in the general election.
e. WMUR and UL have now announced they are apparently planning a reprise of their 2016 debate fraud, with a new round of “debates.”
f. The only candidate who has had a significant impact on the 2018 primary has been Plaintiff. After the media/defendants did nothing, Plaintiff successfully negotiated with the New Hampshire Attorney General a Right to Know (“RTK”) release of damaging documents involving candidate Andy Sanborn (those fact-based damaging disclosures from the Attorney General are still continuing). WMUR jumped on Plaintiff’s RTK agreement and claimed that release of the RTK documents was WMUR’s own accomplishment, refusing to credit plaintiff for proceeding where the media had embarrassingly failed to investigate. The Sanborn disclosures created a major storm and are still reverberating with new document releases planned before August 17.
g. Likewise, WMUR and UL have been promoting Eddie Edwards as a legitimate candidate, and doing nothing to investigate Edwards’ background. Once again, Plaintiff began an investigation and again using the RTK law obtained the release of documents disclosing that Edwards had profited from bogus claims of racial discrimination. Once again WMUR claimed the RTK release was its own effort, when that was contrary to the facts.
h. It is bizarre that while WMUR and UL refuse to acknowledge that Plaintiff is a candidate, they have no hesitation to steal Plaintiff’s work product and claim it as their own. Defendant John DiStaso desperately tries to employ subterfuges such as “major candidates” to exclude Plaintiff. But DiStaso’s “major candidates” have major deficiencies and are slowly destroying each other. One “major candidate” simply quit.
i. Plaintiff continues to investigate, and will be collecting tens of thousands of pages of documents on Edwards, which WMUR and the UL will no doubt appropriate and claim as their own if they find anything of value in Plaintiff’s prospecting.

C. Republican Party debate fraud/violation of bylaws
a. The Republican State Committee bylaws contain provisions prohibiting preferential treatment for candidates and a non-endorsement policy in primary elections, see https://www.nh.gop/bylaws.
b. On or about August 6 the Republican Party announced that it was sponsoring a “debate” with “partners.” Although “qualifications” were promised by August 8, as of the afternoon of August 10 when this Complaint was prepared, less than one week before the event, none have been promulgated.
c. It is apodictic that being excluded from a party-sponsored debate is highly injurious to a candidate.
d. Plaintiff has relied on the Defendants’ neutrality bylaws as a basis to support the party, most recently by purchasing $250 of tickets to a State Party-sponsored event (Spring to Victory Dinner).
e. Common sense suggests that supporters of plaintiff’s primary opponents are using and misusing the State Committee’s assets and resources to damage Plaintiff’s candidacy and to endorse and support the candidacy of their own candidates, all in violation of the state party’s bylaws.
f. The defendant State Committee’s bylaws are intended to be binding on the defendants and to hold out the State Party as a rules-based organization which deals with all GOP candidates on a fair, neutral and non-discriminatory basis.
Bylaws must be respected and enforced, both by organizations themselves and, if necessary, by courts, see e.g. Wesson v. Nashua Police, 103 N.H. 104, 165 A.2d 585, 586-587 (N.H. 1960).
g. The State Committee defendants take an oath to serve as officers of the state party, and to obey and uphold the bylaws of the party barring preferential treatment for some candidates in contested primary elections.
h. That the GOP defendants’ behavior is tawdry and corrupt can be seen from the identical congressional primary activity in the Democratic Party. The Democrats have eleven (11) candidates running in the same congressional primary and treat all of them with respect. i. Republicans are left with five (5) candidates but are seeking to promote only two candidates, while erasing the remaining candidates from party-sponsored activities and public consciousness.
j. Therefore, in establishing the “reasonableness” or “unreasonableness” of the defendants’ behavior to satisfy various standards, there is a clear dichotomy between the conduct of the Democratic Party and the scandalous corruption and abuse of power by the Republican Party leadership which the Court can consider and juxtapose as relevant.
k. The Republicans have now recruited iHeart Media, Jack Heath, a local entertainer, and Citizens for Responsible Energy Solutions to help provide cover for and aid and abet in their latest debate fraud.

IV.

Legal Claim

1. The Defendants are violating Plaintiff’s statutory and New Hampshire constitutional rights and conducting sham proceedings to damage his candidacy.

V.

Demand for judgment

Plaintiff prays that the Court award the following
relief:
1. Emergency injunctive relief including a TRO barring the defendants from (i) conducting rigged polls or (ii) using the GOP’s State Committee’s money or auspices/endorsement to orchestrate unlawful debates in violation of party bylaws and from which legitimate candidates are excluded.
2. Damages from each defendant in the amount of $50,000.
3. Reservation of jurisdiction to award additional relief if the defendants violate the Court’s rulings and/or persist with their unlawful and defamatory course of conduct.
4. For such other relief as may be necessary and proper to do complete justice to Plaintiff, including additional money damages.

COUNT TWO

[Defamation by implication under New Hampshire law]
[All defendants]

1. New Hampshire law recognizes defamation by implication.
2. By deliberately and consciously excluding Plaintiff from their purported “debates,” and pretending Plaintiff does not exist as a candidate, defendants intend to and have defamed Plaintiff by implication, by suggesting he is not a legally-qualified or recognized Republican candidate who should be participating in a party-sponsored or media-sponsored debates.
3. Defendants are constitutionally entitled to their own opinions, on their editorial pages or broadcast comments (or poll commentary). But they are not entitled to their own “facts,” erasing legitimate candidates to deceive the voting public through the use of bogus “polls” and “news” reports which erase Plaintiff as a candidate for office. Defendant Landrigan, apparently on the orders of Defendant McQuaid, refuses to acknowledge Plaintiff’s status as a congressional candidate although he publishes “fluff” pieces about candidates for lesser office (e.g. Cormier, August 8).

COUNT THREE

[Violation of Consumer Protection Act (CPA), RSA ch. 358-A]

1. Numerous defendants are engaged in commercial, profit-making activity. Others, such as UNH and St Anselm, seek to attract paying students to the “Survey Center” and “Institute of Politics” without alerting potential students to the blatant fraud in their operations. Money is at the root of what they do. Politics is big business in New Hampshire. It is also part of a massive nationwide political industry which services candidates and allows individuals to leverage profit-making opportunities from election cycle to election cycle.
2. Because the Republican Party defendants control political activity within the party, they are adjuncts to and potential financial beneficiaries of their own decisions. For example, one of the primary candidates in Plaintiff’s election is a saloonkeeper who receives regular patronage from party functions.
3. The Republican Party defendants hold themselves out as impartial in primary elections and feature bylaws on their web site to manifest their self-imposed restriction on their own political powers and discretion, see https://www.nh.gop/bylaws
4. While the Republican Party defendants are apparently under no statutory mandate to restrict their endorsement authority, they have voluntarily chosen to do so because it is “good business.” The appearance of primary neutrality promotes party fundraising. Contributors are led to believe they are giving to an organization that does not favor or endorse one primary candidate over another and is merely fighting the opposing political party.
5. All of the defendants’ actual behavior is extremely deceptive and meets the “rascality” test of New Hampshire’s Consumer Protection Act. In any honest poll of candidates, or public perception of the disconnect between the limitations on the defendants by their self-imposed by the bylaws or their self-laudatory claims to “media independence and integrity,” and the defendants’ actual actions demeaning and seeking to destroy Plaintiff’s candidacy, almost any “reasonable person” would believe the defendants are bald-faced liars and phonies. The defendants’ behavior is therefore unlawful under the rascality test, ACAS v. Hobert, 155 N.H. 381, 923 A.2d 1076, 1094 (N.H. 2007).

COUNT FOUR

[Civil conspiracy]

1. New Hampshire recognizes the law of civil conspiracies, e.g. Appeal of Armaganian, see e.g. 147 N.H. 158, 784 A.2d 1185 (N.H. 2001). This lawsuit arises in response to a series of civil conspiracies, all motivated by an intent to rig the 2018 primary election and damage Plaintiff’s candidacy.
2. Having taken an oath to use their party offices to remain neutral in primary elections, the Republican Party defendants have come together in a civil conspiracy to benefit some candidates, by spending party funds to showcase them in a “debate” and other activity, while seeking to demean other candidates such as Plaintiff by refusing to permit them to participate in a party-sponsored activity.
3. The media defendants are conducting sham “debates” using bogus, unelectable Republican candidates as Manchurian Candidates to defraud Republican primary voters into supporting unelectable candidates and, after the primary election, reelecting Democrats to office in 2018.
4. The university and college are doing what UNH has always done and what STA has started doing, conducting bogus biased “polls” which favor the Democratic Party and seek to erase Plaintiff as a legitimate candidate in the Republican primary. With Soviet era contempt for reality, both polls simply erased Plaintiff’s presence from their polls. Whether this was done at the behest of paying clients or simply out of their own internal arrogance and corruption will be ascertained through discovery.
5. Plaintiff has been and is being damaged by the civil conspiracies organized and orchestrated by the defendants, which is only one in a continuing series of concerted efforts by the defendants and other coconspirators to violate their responsibilities to their voters, contributors, viewers, listeners and New Hampshire citizens.

COUNT FIVE

[Breach of Fiduciary Duty]
[Only NH GOP defendants, iHeart Media and
Citizens for Responsible Energy Solutions]

Limitations
This Count is directed at the Republican Party-affiliated defendants as well as their “partners,” iHeart Media, Jack Heath and Citizens for Responsible Energy Solutions who are aiding and abetting in the civil conspiracy and fraud of the GOP officials.

Plaintiff repeats and realleges II-III of Count One and further pleads:

Legal Claim
1. The GOP defendants assumed a fiduciary duty to the New Hampshire Republican State Committee and undertook to serve honorably and with fidelity to their own bylaws.
2. While seeking to promote party probity in public, the defendants have been scheming in private to violate their oaths of office and to violate their fiduciary duties under their organization’s bylaws not to endorse or favor candidates in primary elections.
3. Candidates are induced to participate in party primaries, and to spend substantial sums on party events, on the basis that the party under its bylaws will remain neutral and not favor one candidate over another in primary elections.
4. The defendants, by their open and notorious behavior to expend party funds through GOP Treasurer Rob Kasper, and by advertising and promoting bogus “debates” on their web site on behalf of some primary candidates, while preventing other candidates from participating on an equal basis with their opponents in those party-sponsored events, egregiously violated their fiduciary duties to their party organizations.
5. While a French king is reputed to have said, “L’etat, c’est moi,” (I am the state), the defendants are not the party and are merely temporary holders of party offices who must serve in conformity with their obligations to the ongoing political organization whose finances are closely supervised by New Hampshire law and public officials, see generally RSA Ch. 664, Sumner, supra.
6. The defendants are not “free agents” who may do as they choose; they are fiduciaries of their party organization and party finances and may not violate their duties to their party organization as set forth in detail in party bylaws by sponsoring a debate or other activity for some but not all of the candidates.
7. Although the GOP defendants announced a week ago that they would announce “qualifications” on August 8, as of the afternoon of August 10 when this Complaint was prepared, no “qualifications” had been posted as promised.
8. iHeart Media, Jack Heath, Citizens for Responsible Energy Solutions and James Dozier have acted, combined and conspired in a civil conspiracy with the State Committee defendants, in violation of the GOP defendants’ fiduciary duties, to conduct a fraudulent “debate” from which plaintiff is apparently being excluded.

(Manchester, NH)(August 14, 2018) — Republican congressional candidate Andy Martin will hold a news conference Tuesday to question the unusual connection between two Democratic Party leaders. Later, Martin will unveil for New Castle Republicans his general election strategy for winning the first congressional district.

Monday Martin filed a lawsuit challenging GOP state party leaders’ efforts to conduct a corrupt candidates’ “debate” this week in violation of the party’s bylaws requiring strict party neutrality in primaries.

“Because I am a different kind of candidate,” Martin says, “I run a different kind of campaign. But no one can dispute that my efforts in the primary have changed the face of the election, repeatedly. My Right to Know agreements significantly embarrassed two of my opponents, with more documents yet to come. My disclosures have been the most unscripted elements in the current primary. That’s why my presence draws interest, and why trying to exclude me from a debate is self-defeating.

“To lock me out of a debate shows just how out of touch with reality the Republican Party leadership really is. They will be making laughingstocks of the party’s neutrality bylaws by trying to rig the outcome. As President Trump would say, ‘They are going to pay a heavy price for their dishonesty and disloyalty. They are not very smart people.’

“When we unleash our retaliation, it will suck the air out of the GOP conspirators’ general election campaign. The goofy GOP ‘leaders’ will know what it feels like to be one of my opponents.

“But, on a different level, at my news conference today I feel compelled to jump, if only briefly, into the Democrats’ congressional primary. One of the candidates, Levi Sanders, hinted at a recent forum in Laconia that there may be some collusion between the state chairman, Ray Buckley, and candidate Chris Pappas. My campaign is probably the only Republican campaign that closely monitors the Democrats. Sanders’ contretemps with Buckley caught my attention. We took a deeper dive.

“With a little digging by our Bureau of Investigation we came up with my question of the day for today: Why is Ray Buckley managing Chris Pappas’ DNA on line (ancestry.com)?

“Or, put another way, if Pappas and Buckley are so close that Buckley manages Pappas’ DNA and family tree online, should Buckley be presiding at events where Pappas is a candidate?

“I’m a Republican so, until the day after the primary, Democrats are of limited interest to me. But because of my investigative background and our success in using New Hampshire’s Right to Know law to ferret out embarrassing information about Republican candidates, we get raw information about Democrats and Republicans dumped on our doorstep almost every day.

“Still, the closeness of the connection between Pappas and Buckley is clearly worth considering when Buckley is presiding at events where Pappas is a candidate” Martin observes. “Can anyone help me with this?”

“Tuesday I will also have the pleasure of addressing a very serious audience in New Castle. I will explain my strategy to beat the Democrat in November. I have a strategy; my primary opponents do not. The First Congressional District is an educated, sophisticated district. It may be R +2 or whatever, but that number means nothing ‘on the ground’ where we live our lives. We have intelligent voters; they demand a candidate who is in sync with the district, not a bobblehead who spouts stale talking points. New Castlers have asked for a positive presentation and I will endeavor to meet their expectations. I think they will find my views serious and substantial.”
